1. Acceptance

These Terms & Conditions (“Terms”) govern your use of StoryCall’s website and services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Not for emergencies. StoryCall is not designed for emergency, time-sensitive, or critical communications. If you have an emergency, call local emergency services immediately.

2. What StoryCall Does

StoryCall converts voice messages or recordings you send by text/SMS into phone calls to a landline (or other phone number you provide), then returns a recorded reply back to the same message thread. The Service may include optional transcription and other features. Delivery may be delayed or unsuccessful due to carrier filtering, network conditions, or third-party platform limitations.

3. Safety and Consent

3.1 Permission to contact

  • You represent and warrant that you have permission to contact any Recipient you add or message through StoryCall, including any required consent for automated or prerecorded calls and messages where required by law.
  • You will not use the Service for harassment, spam, deception, or unlawful purposes.

3.2 Recipient opt-out

  • Recipients can stop future calls by texting STOP to 844-961-2835 at any time. You agree not to attempt to override or circumvent opt-out.

3.3 Recording and consent

  • You are responsible for obtaining any required consent to contact and to record a Recipient under applicable law. Recipients are informed at the start of calls that the call may be recorded.
  • You agree not to use the Service for emergencies. StoryCall is not a substitute for calling emergency services.

4. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for activity that occurs under your account.
  • You agree to provide accurate information and to keep it up to date.

5. Your Content and Our License (Minimal, Service-Only)

You retain ownership of your Content. To provide the Service, you grant StoryCall a limited, non-exclusive license to host, process, transmit, and display your Content solely as necessary to operate the Service, improve reliability and functionality, troubleshoot issues, and maintain safety and security. We do not claim ownership of your Content.

We do not sell your Content or use it for advertising purposes.

6. Prohibited Uses

  • Harassment, threats, hate, or abusive conduct.
  • Spam, robocalling abuse, or sending unsolicited bulk messages.
  • Impersonation, fraud, or deceptive practices.
  • Illegal content or use that violates laws or third-party rights.
  • Attempts to probe, scan, or breach security; or reverse engineer the Service where prohibited.

7. Third-Party Services

The Service may interact with third-party platforms and providers (e.g., messaging platforms, telecom carriers, hosting providers). Your use of those services is governed by their terms and policies. StoryCall is not responsible for outages, policy changes, filtering, blocking, delivery failures, delays, or actions by third parties.

8. Availability, Changes, and Support

  • We aim to provide a reliable Service, but we do not guarantee uninterrupted availability.
  • We may modify or discontinue features to improve the Service or for safety, legal, or operational reasons.
  • Support requests can be sent to help@storycall.org or by texting HELP to 844-961-2835.

9. Fees and Carrier Charges

Fees (if any) will be disclosed in the app experience. Standard carrier charges may apply for calls or texts depending on your or the Recipient’s plan. StoryCall is not responsible for carrier fees.

10. Termination

  • You can stop using the Service at any time.
  • We may suspend or terminate access if we reasonably believe you violate these Terms or pose risk to others or the Service, including for robocalling abuse, spam, or consent or recording violations.
  • Recipients can opt out by texting STOP at any time.

11. Recipient Rights (Limited Third-Party Beneficiary)

Recipients are intended third-party beneficiaries of Sections 3.2 and 3.3 solely to enforce opt-out and recording/consent provisions. No other third-party rights are created by these Terms.

12. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, StoryCall disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, StoryCall will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. In all cases, StoryCall’s total liability for any claim will not exceed the amount you paid to StoryCall for the Service in the 12 months prior to the event giving rise to the claim (or, if you paid nothing, US $100), except where liability cannot be excluded under applicable law.

14. Indemnity

You agree to indemnify and hold harmless StoryCall from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service or your violation of these Terms, including your Content, your communications with Recipients, and any claims related to required consent, recording, or automated/prerecorded communications.

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Exclusive venue for disputes will be in state or federal courts located in San Francisco County, California, except where prohibited by law.

16. Changes to Terms

We may update these Terms from time to time. If changes are material, we will provide notice in the Service or by other reasonable means. Continued use after the effective date means you accept the updated Terms.

17. Miscellaneous

  • Entire agreement: These Terms, together with any referenced policies, are the entire agreement regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No waiver: Failure to enforce a provision is not a waiver of the right to do so later.
  • Assignment: You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or asset transfer.
